Representation: This open space can be retained as confirmed by barrister Jonathan Clay opinion dated 20/08/16 and the council should retain it in line with policy. They are choosing to let it be developed because it makes the planning departments life easier.

Original submission

This site is allocated as open space within the adopted development plan in October 2010 and has not gone through the correct procedures to change its allocation from open space. This open space already existed when the local plan was adopted therefore there is no reason why it should not be retained and safeguarded in line with adopted policy. and continue to be safeguarded and retained. The DAS referred to by the planning department does not definitively mean that this land has to change from open space, as is confirmed by barrister Jonathan Clay in his legal opinion dated 20/08/16, which was sought by the Stanway Parish Council when hundreds of objections were raised by residents, local councillors and MP's regarding reserved matters application 152817, which sought to develop this much loved open space and amenity land. The council planning department are allowing a change of use of this land without going through the correct procedures and should only allow a change of use if it is granted in the correct manner.
