Representation: Please refer to 152817 which includes this parcel of land. Residents, SPC, Rt Hon Priti Patel and Cllr Kevin Bentley have all strongly objected to this application. There was no public consultation, as stated in the current DP15 CBC Policy and also contained within paragraph 74 of the NPPF, that can change the designation of land from Public Open Space to residential. Furthermore, this parcel of land should have been fully landscaped in 2006 as per a Discharge of Condition 03 (97/1428) and CBC are in breach of this condition, this has been confirmed by Daniel Cooper 'Planning Enforcement Officer'.

Original submission

Please refer to Planning Application 152817 which includes this parcel of land. There are over 130 objections and also a petition containing over 1,000 signatures. Local residents, Stanway Parish Council, Rt Hon Priti Patel and Cllr Kevin Bentley have all strongly objected to this application. There was no public consultation, as stated in the current DP15 CBC Policy and also contained within paragraph 74 of the NPPF, that can change the designation of land from Public Open Space to residential. Although the DAS 2010 was discharged lawfully the information contained within this document is incorrect. The DAS was also discharged by delegated powers and never went to Planning Committee so who checked that the information was correct? Furthermore, this parcel of land should have been fully landscaped in 2006 as per a Discharge of Condition 03 (97/1428) and CBC are in breach of this condition, this has been confirmed by Daniel Cooper 'CBC Planning Enforcement Officer'. How can CBC allocate this parcel of land in the forthcoming Local Plan and safeguard the delivery of up to 28 dwellings when the Planning Committee have not decided the outcome of the above mentioned application?
